Though unexpectedly losing a loved one is not easy on any family, it can be even more difficult if the family believes that purposeful wrongdoing contributed to the death. One family in Colorado may be considering this type of legal action after a fatal hit-and-run accident. Apparently, a 67-year-old man was driving a motor home when he crossed the oncoming traffic lanes and drove onto the sidewalk. A 44-year-old woman was on the sidewalk at the time, and she was run over by the motor home. The man driving did not remain at the scene.
The woman was taken to the hospital, but she succumbed to the injuries she suffered. Authorities were later able to locate the driver of the motor home, and he was recently taken into custody. Authorities do not believe that the man’s actions were intentional, but the woman’s niece suspects that it was purposeful.
The family is obviously devastated by the sudden loss of their loved one, and it can take a considerable amount of time to heal from such an event. As they work to process their feelings and the incident itself, they may want to consider filing a wrongful death claim against the driver considered at fault. A successful claim could allow them to recover monetary damages allowed under Colorado law.
